When you are banned from banking, the prohibitions are as follows: you can no longer possess or issue a check, and you can no longer subscribe to a loan. The check ban applies to all your accounts, even if it is a joint account. If you have given power of attorney to someone and they have issued an NSF cheque, it is you who will still be banned from banking, this must be taken into consideration.

In addition, depending on the bank, it may be decided to:

  • close your account,
  • remove your means of payment (credit card, checkbook),
  • remove your overdraft.

It depends on the banks: some will close your account directly, others will remove your overdraft and give you an electronic card… In any case, what is certain is that the bank will drastically tighten your banking rights.

If your account has been closed, you no longer have a means of payment, in particular the credit card, which is a very complicated situation when you know that nowadays it is easier to pay by credit card rather than in cash, and when you know the importance of an overdraft. What are the risks if I do not return my means of payment?

In the event of a non-return of your checkbooks, you risk criminal sanctions such as a fine or a legal ban.

How long does the banking ban last

The maximum duration of the banking ban is 5 years. You will be registered in the central check file (FCC), and after this period you will no longer be prohibited from banking. You have 2 months to regularize the situation. Beyond that, you will only have the legal route to get out of the banking ban.

The first thing to do when you have issued a check and think it will be returned NSF is to notify your bank. The more you anticipate, the better it is for you. You need to have a good relationship with your advisor. You simply explain to him the situation and why this month you had to write this check, and that your money arrives. The more you have a valid justification, the easier the amicable agreement will be.

Instead of waiting for 5 years, you have a period during which you can regularize the situation. For example, for a check you issued that is NSF, you can return the funds to a 2-month delay. You can justify to the banks concerned that you have put the funds in the account in order to regularize the situation and, subsequently, the banks must inform the Banque de France that you have regularized the situation. The banking ban will then no longer be necessary. After 2 months, if you think that the banking ban is unjustified or abusive, you can file a complaint to assert your rights with the National Commission for Information Technology and Liberties (CNIL) or with the public prosecutor.

The best advice I can give you is to avoid paying by check because you don’t have control: the person to whom you give the check can take months and months to cash the money and if you do not have the funds at that time, you are in trouble, whereas by paying by credit card or by transfer, the money is debited almost instantly and you are therefore more relaxed. Above all, do not have fun writing checks because afterward, the sanction will last 5 years. 5 years is a very long time without a check or credit card (even if we have seen that it is still possible to have an account and a credit card, but without being able to access credit).

What aid in the event of a banking ban?

Once registered in the central check file, it will be impossible to obtain credits. However, you can, through the family allowance fund (CAF), obtain social loans, emergency loans or loans to equip you.
